Who can file a wrongful death claim in Florida?
Under Florida Statute 768.21, the case is filed by the personal representative of the deceased person's estate — usually named in the will, or appointed by the probate court if there's no will. The damages recovered flow to surviving family: the spouse, children, parents (especially of a deceased minor child), and blood relatives or adoptive siblings who depended on the deceased for support. What's the difference between a wrongful death claim and a criminal case?
Different proceedings, courts, and standards. A criminal case is the state prosecuting the responsible person and must prove guilt beyond a reasonable doubt, aiming at punishment. A wrongful death civil claim is your family, through the personal representative, seeking financial compensation, with a lower standard of proof (preponderance of the evidence). The two can run in parallel, and your family's civil claim is a separate right with its own 2-year filing window.
How long do I have to file a wrongful death lawsuit in Florida?
Two years from the date of death, with narrow exceptions. Florida's wrongful-death deadline was not affected by the 2023 personal-injury change — it has been 2 years for a long time. Some fact patterns (fraud, concealment) can extend it, but it's safest to file protectively rather than rely on exceptions.
